Project Overview
John worked as a Consultant on the Burj Khalifa, the 828m-high, 163-storey tower in Dubai and the world’s tallest building. He formed part of the employer-side team reviewing contractor claims arising from the approximately $1bn construction contract, administered under the FIDIC Red Book.
Challenges
The employer was dealing with substantial and complex claims arising from construction of a highly technical building involving numerous interdependent work packages. A key issue was establishing the factual basis of alleged delay and change events and assessing whether the contractor had complied with the contractual notice provisions.
Contribution
John investigated project records and prepared factual reports covering major packages including reinforced concrete, interior fit-out and cladding. The role also included a detailed review of contractual notice compliance. More than 700 instructions were analysed against the requirements of the FIDIC contract, together with notice compliance associated with more than 1,000 alleged delay events. The findings were presented through structured reports and graphical analysis to make a substantial volume of information easier to understand.
Results
The claims review converted a very large volume of instructions, records and alleged delay events into a more structured employer-side commercial position. John was retained for further work as the wider team reduced, including additional support around counterclaims and cost verification.
